BrainBody Wellness and Biofeedback, PLLC, DBA BrainBody Counseling ("BrainBody Wellness," "we," "us," or "our") respects your privacy.
This Privacy Policy describes our privacy practices in connection with the brainbodywellnessaz.com website (the "Site") and the BrainBody Wellness mobile application (the "App"). It describes the types of information that may be processed through the Site and App, how that information may be used or disclosed, and the choices available to users regarding their information.
Certain provisions of this Privacy Policy apply specifically to the Site or specifically to the App, as indicated below.
Please read this Privacy Policy carefully. By accessing or using the Site or App, you acknowledge the privacy practices described in this Privacy Policy.
We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and update the Effective Date above.
WEBSITE PRIVACY PRACTICES
How We Collect and Use Website Information
We may collect and store personal or other information that you voluntarily provide to us while using the Site, including information submitted through online forms, email sign-ups, scheduling inquiries, event registration, purchases, or other website features.
Depending on how you interact with the Site, this information may include your name, email address, telephone number, postal address, payment information, or other information that you voluntarily provide.
We may use information collected through the Site to respond to requests, provide requested services, communicate with you, process transactions, provide information about our services, improve the Site, and support our business operations.
Information Collected Automatically Through the Site
We may collect certain information automatically as you navigate the Site, such as information about your browser, device, connection to the Internet, and interactions with the Site.
The Site may use cookies, web beacons, pixels, or similar technologies to help us understand how visitors use the Site, remember preferences, measure traffic, improve functionality, and support advertising and marketing activities.
Website Advertising and Third-Party Services
We may use third-party service providers, contractors, publishers, advertising providers, and other vendors to assist with operation of the Site, communications, analytics, advertising, or other business functions.
These third parties may collect or receive information through cookies, pixels, web beacons, or similar technologies when you interact with the Site. Their collection and use of information may also be governed by their own privacy policies.
The Site may contain links to websites, products, or services operated by third parties. We do not control the privacy practices of those third parties. Information you provide directly to another website or service is governed by that provider's privacy practices.
The website advertising and marketing practices described in this section are separate from the BrainBody Wellness mobile application. Health-related information entered into the App is not used by the App for targeted advertising.
Google Analytics
We may use Google Analytics and related features to understand use of the Site and improve our business and marketing activities.
Depending on the services enabled on the Site, Google Analytics features may include:
Remarketing with Google Analytics;
Google Display Network Impression Reporting;
Google advertising platform integrations; and
Google Analytics Demographics and Interest Reporting.
Google and other vendors may use first-party cookies, third-party cookies, or other identifiers to collect information about activity on the Site.
Users may use Google's available advertising and privacy controls to manage certain uses of information by Google.
Facebook and Social Media Advertising
We may use Facebook or other social media platforms to advertise BrainBody Wellness and communicate with individuals interested in our services.
Information collected through our website or advertising campaigns may be used to evaluate advertising effectiveness and communicate with individuals who have requested information.
We do not use health-related information entered into the BrainBody Wellness App to create advertising profiles or for targeted advertising.
Phone Calls and Text Messages
If you voluntarily provide a telephone number and consent to receive communications from us, we may use that information to respond to inquiries and provide communications regarding our services.
Where required by applicable law, promotional or marketing text messages will be sent only with the appropriate consent.
You may request that promotional communications stop in accordance with the instructions provided with those communications or by contacting us.
Disclosure Required by Law or for Safety
We may disclose information collected through the Site when required or permitted by applicable law, regulation, court order, legal process, or professional obligation.
We may also disclose information when reasonably necessary to protect the rights, property, safety, or security of BrainBody Wellness, our users, patients, or others, consistent with applicable law.
Business Transfers
If BrainBody Wellness undergoes a merger, acquisition, reorganization, sale of assets, or similar business transaction, information maintained by BrainBody Wellness may be transferred as part of that transaction, subject to applicable privacy, confidentiality, healthcare, and other legal requirements.
WEBSITE EMAIL AND COMMUNICATION STORAGE
Information collected through the Site for email communications and messaging may be stored by service providers we use to manage those communications.
Access is limited to authorized individuals and service providers who require access to provide those services.
Marketing or informational emails sent through the Site may contain an unsubscribe link. You may unsubscribe from applicable marketing email communications using the instructions provided in those communications.
This section applies to information collected through the Site. Information stored locally through the BrainBody Wellness mobile application is addressed separately below.
MOBILE APPLICATION PRIVACY
The following provisions apply specifically to the BrainBody Wellness mobile application.
The App is designed to provide educational and therapeutic-support tools, including lessons, self-monitoring activities, exposure-practice tools, an exposure hierarchy, and related features.
Local-First Design
The App is designed as a local-first application.
Information users enter into the App during normal use is stored locally on the user's device rather than automatically transmitted to BrainBody Wellness.
The App does not currently require users to create a BrainBody Wellness App account or profile.
The App does not currently provide BrainBody Wellness with routine remote access to the clinical or therapeutic-support information stored within the App.
Information may leave the device when a user deliberately uses a feature that shares or exports information, as described below.
Information Stored Through the App
Depending on the features a user chooses to use, the App may store information locally on the user's device, including:
Self-monitoring information;
Exposure Hierarchy entries;
Expected or recorded Subjective Units of Distress Scale ("SUDS") ratings;
Exposure-practice information;
Situations, concerns, rituals, response-prevention information, and related notes;
Dates, times, durations, and other information associated with therapeutic exercises;
Information regarding an exposure exercise that is currently in progress;
Lesson-completion information;
User-entered notes or other free-text information; and
A hierarchy photograph selected or taken by the user.
Because this information may relate to mental health, behavioral health, symptoms, experiences, treatment, or therapeutic activities, users should treat information stored within the App as sensitive.
Local Database Storage
Self-monitoring records, Exposure Hierarchy information, exposure-practice information, in-progress exposure information, and lesson-completion information are stored locally in the App's database on the user's device.
The App does not automatically upload these records to a BrainBody Wellness server during ordinary use.
A user may choose to share certain information outside the App using the report-sharing feature described below.
Hierarchy Photos
The App allows users to take a photograph using their device's camera or select an image for use with the Exposure Hierarchy feature.
When a hierarchy photo is selected, the App processes and stores a copy of the image within the App's private file storage on the user's device.
The App does not automatically upload the hierarchy photo to BrainBody Wellness.
The App does not intentionally store a remote URL for the hierarchy photo.
If a user deletes the hierarchy photo from within the App, the App deletes its locally stored copy.
Deleting the App's copy does not delete the original photograph from the user's device photo library.
Deletion also cannot delete copies of the image that the user previously exported, shared, saved elsewhere, or provided to another person or service.
Depending on the user's device and platform settings, device backups or other platform-managed copies may be outside the App's direct control.
Camera and Photo Library Access
Certain App features allow users to take a photograph or select an existing image.
The App may request access to the device camera when the user chooses to take a photograph.
Photo selection may also use Apple's system photo-selection functionality.
These capabilities are used to provide the hierarchy-photo feature.
Users may control applicable permissions through their device settings.
A hierarchy photo is optional.
Reports and User-Directed Sharing
The App allows users to create a PDF report from information stored locally within the App.
Depending on the options selected by the user, a report may include information such as:
Self-monitoring records;
Exposure-practice information;
Exposure Hierarchy entries; and
The user's hierarchy photo.
Reports are generated locally on the user's device.
When the user chooses to share a report, the App uses the device's operating-system sharing functionality. The user chooses where or to whom the report is sent.
A report may therefore leave the user's device when the user deliberately chooses to share, save, transmit, or export it.
BrainBody Wellness does not control third-party applications, services, recipients, storage locations, or other destinations selected by the user through the device's share functionality.
Users should consider the sensitivity of the information contained in a report before choosing a recipient or destination.
After the sharing process, the App attempts to remove temporary report files that it created locally. Copies saved, transmitted, or otherwise retained outside the App are not controlled by the App and cannot be deleted through the App's local-data-erasure feature.
Lesson Progress and App Activity
The App stores certain lesson-completion information locally, including identifiers associated with completed lessons and completion timestamps.
The App may also store dates, timestamps, and other information associated with clinical or therapeutic-support entries.
The App does not currently use a mobile behavioral-analytics or session-replay service to create a remote history of users' activity within the App.
Device Authentication and Security
The App may use device-level authentication, such as Face ID, Touch ID, or the device's passcode functionality, to help protect information within the App.
This device authentication does not create a BrainBody Wellness user account.
The App does not receive or store a user's biometric template.
Biometric or device-passcode authentication is handled by the user's device and operating system.
We use reasonable measures within the App designed to help protect locally stored information. However, no device, storage method, software, or security measure can be guaranteed to be completely secure.
Users are responsible for maintaining appropriate security for their devices and device credentials.
Advertising, Analytics, and Tracking in the App
The App does not currently use health-related information stored within the App for targeted advertising.
The App does not currently sell information concerning users' mental health, behavioral health, exposure activities, or therapeutic-support activities.
The App does not currently contain a mobile advertising or attribution system designed to track users across apps or websites owned by other companies.
The App does not currently request Apple's App Tracking Transparency permission for advertising tracking.
The App does not currently include an App-integrated behavioral analytics, session-replay, or remote crash-reporting service that receives the user's locally stored clinical entries.
These statements apply to the mobile App and should not be interpreted as descriptions of analytics, advertising, cookies, or similar technologies that may separately be used on the BrainBody Wellness website.
Location and Other Device Information
The App is not designed to collect a user's precise or approximate geographic location as part of its therapeutic-support features.
The App does not currently use contacts, HealthKit, motion or fitness information, calendar information, or Bluetooth data as part of its therapeutic-support functionality.
When a user chooses to open an external website from the App, that website and the user's browser or network provider may process ordinary Internet connection information, such as an IP address, according to their own practices.
Push Notifications
The App does not currently register users for BrainBody Wellness push notifications or collect push-notification device tokens.
If this functionality is added in the future, this Privacy Policy may be updated as appropriate.
Deleting Individual App Information
Certain App features allow users to delete individual records or information stored within the App.
For example, users may delete hierarchy items, self-monitoring records, exposure-practice records, or the hierarchy photo where the applicable deletion feature is available.
Deleting a current Exposure Hierarchy item does not necessarily delete information contained in previously completed exposure-practice records. A historical exposure-practice record may retain information regarding the exposure that was performed.
Users who want to erase the App's locally stored information more broadly may use the Erase My Data feature described below.
Erase My Data
The App does not currently use a BrainBody Wellness user account, so there is no App account that must be deleted.
Instead, the App provides an Erase My Data feature within Settings & Privacy.
When a user confirms Erase My Data and completes the required device authentication, the App attempts to erase its locally stored database information and App-managed hierarchy-photo and report files.
This erasure occurs locally on the user's device and is not a request sent to a BrainBody Wellness server.
Erase My Data cannot delete information outside the App's control, including:
Original photographs in the user's photo library;
Reports or files the user previously saved outside the App;
Reports or information previously shared with another person or service;
Copies maintained by recipients;
Information separately provided to BrainBody Wellness outside the App; or
Copies that may exist in device or platform backups outside the App's direct control.
Information separately received and maintained by BrainBody Wellness in connection with healthcare services is not necessarily the same as information stored locally in the App and may be subject to separate healthcare, professional, legal, or record-retention requirements.
Third-Party Services and External Destinations
The App relies on functionality provided by the user's device and operating system for certain features, including camera access, photo selection, device authentication, PDF generation, and user-directed sharing.
If a user chooses to share information through another application or service, or opens an external website from the App, information handled by that destination may be subject to the destination provider's privacy practices.
Users should review the privacy practices of third-party services they choose to use.
CHILDREN AND MINORS
Website
The Site is not directed to children under the age of thirteen, and we do not knowingly collect personal information directly from children under thirteen through website features intended for the general public without appropriate authorization or consent where required by law.
If we become aware that personal information from a child under thirteen has been collected through the Site in circumstances requiring parental consent and such consent was not obtained, we will take appropriate steps consistent with applicable law.
Mobile Application and Minor Patients
The App may be used in connection with services involving minors.
Information entered into the App is generally stored locally on the device as described above.
Information concerning minors that is separately received or maintained by BrainBody Wellness in connection with healthcare services will be handled in accordance with applicable law and any applicable authorization, consent, legal decision-making authority, court order, or other legal requirement.
A parent, guardian, or other individual requesting access from BrainBody Wellness to information concerning a minor may be required to provide documentation sufficient to establish identity and legal authority before information maintained by BrainBody Wellness is disclosed.
Nothing in this Privacy Policy guarantees a parent, guardian, or other individual access to particular healthcare information. Requests made to BrainBody Wellness for access to records maintained by BrainBody Wellness will be evaluated in accordance with applicable law and any controlling court orders or other legal requirements.
HEALTHCARE PRIVACY AND CONFIDENTIALITY
The App is a therapeutic-support tool and may be used in connection with healthcare services. However, information that remains solely within the App's local storage is distinct from information that has actually been received and maintained by BrainBody Wellness.
If information is separately transmitted or provided to BrainBody Wellness and constitutes protected health information or is otherwise subject to federal or state healthcare privacy or confidentiality requirements, BrainBody Wellness will handle that information in accordance with applicable healthcare privacy and confidentiality laws and professional requirements.
For example, a user may choose to share information generated by the App with a healthcare provider. Once information is actually received and maintained as part of healthcare services, different privacy, confidentiality, documentation, and record-retention requirements may apply.
This Privacy Policy describes privacy practices relating to the Site and App. It does not replace any Notice of Privacy Practices that BrainBody Wellness may be required to provide under applicable healthcare privacy law.
Where a separate Notice of Privacy Practices applies to protected health information maintained by BrainBody Wellness, that notice may provide additional information regarding permitted uses and disclosures and applicable individual rights.
YOUR PRIVACY CHOICES AND RIGHTS
Depending on applicable law, the nature of the information, and your relationship with BrainBody Wellness, you may have rights to request access to, correction of, amendment of, or deletion of certain information actually maintained by BrainBody Wellness.
Requests may be subject to identity verification and to limitations, exceptions, or retention requirements imposed or permitted by applicable law.
Rights relating to medical, behavioral-health, or other healthcare records may be governed by separate federal or state healthcare laws and may differ from rights relating to ordinary website information.
For information stored only locally within the App, users can manage or erase applicable information using the App's available deletion and Erase My Data features.
BrainBody Wellness generally cannot retrieve or delete information that exists solely in local App storage and has never been transmitted or otherwise provided to BrainBody Wellness.
Privacy requests concerning information maintained by BrainBody Wellness may be submitted using the contact information below.
GENERAL DATA PROTECTION REGULATION (GDPR)
The General Data Protection Regulation ("GDPR") provides certain rights to individuals in the European Economic Area ("EEA") and other jurisdictions where the GDPR applies.
BrainBody Wellness does not specifically target its marketing or services to individuals in the European Union or EEA. However, to the extent that information we process is subject to the GDPR, we will comply with applicable requirements.
Depending on the circumstances, individuals whose information is governed by the GDPR may have rights concerning access, correction, deletion, portability, restriction of processing, or objection to certain processing.
These rights apply to information actually processed by BrainBody Wellness as provided by applicable law. Information stored solely on a user's device through the App may instead be managed using the App's local deletion features.

THIRD-PARTY LINKS AND SERVICES
The Site or App may contain links to or allow interactions with websites, applications, or services operated by third parties.
When you interact directly with a third-party website, application, sharing destination, or service, that third party's privacy practices may apply to information you provide or transmit to it.
BrainBody Wellness does not control the privacy or security practices of third parties.
We encourage users to review the privacy policies of third-party services they choose to use.
CHANGES TO THIS PRIVACY POLICY
We may modify this Privacy Policy from time to time to reflect changes in our practices, technology, services, App functionality, legal requirements, or other circumstances.
When we make changes, we will post the updated Privacy Policy on this page and revise the Effective Date at the top of the policy.
We encourage users to review this Privacy Policy periodically.
